A de que, diante de um caso difícil, não existe apenas uma resposta pronta esperando para ser encontrada — mas diferentes caminhos possíveis, todos com algum grau de justificativa. Ronald Dworkin sugeria algo próximo disso ao tratar o Direito como uma prática interpretativa. Não no sentido de liberdade absoluta. Mas no sentido de que, muitas vezes, o trabalho jurídico está menos em “descobrir” uma resposta e mais em construir a melhor resposta possível. Na prática, isso aparece de forma sutil. Há momentos em que o texto parece claro — e ainda assim exige escolha. Momentos em que o argumento decisivo não está explícito — mas precisa ser desenvolvido. Talvez por isso a advocacia tenha algo de menos mecânico do que se costuma imaginar. E algo de mais criativo do que normalmente se admite.
